Andrew Charles unsuccessfully claimed damages for "chronic strain of the ligaments and tendons in front of both wrists" which he alleged he sustained while delivering bottles of water weighing around 20 kg. It was agreed during the trial that HH Judge Harington should first consider the question of whether the Claimant had established that he suffered the condition about which he complained, and, if he had, whether he had established that that condition was caused by him having to lift bottles from the stillages and handle them in the way he alleged. The Judgment does not address the Defendant's alleged breaches of duty, HH Judge Harington having found that the Claimant had failed to establish either that he suffered the alleged strain to the ligaments and tendons or that any pain or discomfort that he did suffer was caused by his work.
