an excerpt from a publication by the Health and Safety Executive (the dates unknown) entitled Upper Limb Disorders in the Workplace, Appendix 3, entitled Medical Aspects of Upper Limb Disorders. This document contained a helpful A-Z of upper limb disorders and their definitions.

In the Judgment at first instance on the 4th January 2008, at D on page 13, there is reference to Work Related Upper Limb Disorders: A Guide to Prevention:

This was a Health and Safety Executive booklet, whose title is self-explanatory. Its scope covers all types of upper limb disorders, but its focus appeared to be particularly on manual or production line work and does not as I saw it carry any specific or illustrative reference to keyboard work.

In the Judgment at first instance on the 4th January 2008, at C on page 22, HH Judge Dixon states:

Both of [the Ergonomics Experts] referred extensively to the 1992 Regulations, and [the Ergonomics Expert instructed by those acting on behalf of the Defendant] referred to the Health and Safety Executive's publication Display Screen Equipment, Work Health and Safety (Display Screen Equipment) Regulations 1992, Guidance on Regulations L26. And even [the Ergonomics Expert instructed by those acting on behalf of the Defendant] came to the conclusion that he would have expected the defendants to be aware of this guidance .......

In the Court of Appeal Judgment on the 11th December 2008, at paragraph 4, Lord Justice Jackson states:

The Health and Safety Executive published helpful guidance concerning the 1992 Regulations. This guidance would or should alert employers to the need to protect keyboard workers against the risk of WRULD.
